Terms of Service

These Terms of Service ("Terms") govern your access to and use of PoolStride (the "Service"). By creating an account, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and have authority to bind the business you represent. You are responsible for all activity under your account.
2. Your Account
- Keep your password confidential. You are responsible for everything done with your credentials.
- Notify us immediately of any unauthorized access.
- One account per business entity. Sharing accounts is prohibited.
3. Subscription and Billing
- The Service is offered on a subscription basis (monthly or annual).
- You authorize us to charge your payment method on file on each renewal. Subscriptions auto-renew until canceled.
- You may cancel anytime from Settings → Billing. Cancellation takes effect at the end of the current billing period.
- We do not prorate refunds for partial periods. Annual plans are refundable within 14 days.
- Prices may change with 30 days' notice.
- Failed payments may result in service suspension after 7 days.
4. Free Trial
New accounts receive a 14-day free trial. No payment method required until you upgrade. If you do not upgrade by the end of the trial, your account becomes read-only until you subscribe or delete.
5. Acceptable Use
You agree not to:
- Use the Service for anything illegal
- Send spam, phishing, or unsolicited marketing to customers
- Upload malware, scrape, or attack our infrastructure
- Resell, sublicense, or white-label the Service without written permission
- Reverse engineer, copy, or clone the Service
6. Your Content
You own the data you upload (customers, photos, invoices, etc.). You grant us a limited license to host, process, and display it solely to provide the Service. You are responsible for ensuring you have the rights to upload any content and for your compliance with applicable laws (including obtaining consent from your customers for communications).
7. Communications to Your Customers
If you use the Service to send SMS or email to your customers, you are solely responsible for compliance with CAN-SPAM, TCPA, and similar laws. You must obtain prior express consent before sending marketing communications, and include unsubscribe mechanisms.
8. Payment Processing (for your customers)
If you use the Service to accept payments from your customers via Stripe or Authorize.net, you have a direct relationship with those processors. PoolStride is not a party to those payments and is not liable for chargebacks, disputes, or payment processing outages.
9. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. We may take the Service offline for maintenance, which we'll announce in advance when possible.
10. Termination
We may suspend or terminate your account for material breach of these Terms, non-payment, or prolonged inactivity (12+ months). You may terminate anytime by canceling your subscription and deleting your account.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Delaware. Update this section if you incorporate in a different jurisdiction, and consider a legal review before taking on your first paying customer.
14. Changes
We may update these Terms. Material changes will be announced at least 30 days in advance by email. Continued use after the effective date means you accept the new Terms.
